With only a few mouse-clicks, you can follow the news, look up facts, buy goods and services, and communicate with others from around the world. It's important to Trainerly, Inc. to help our customers retain their privacy when they take advantage of all the Internet has to offer.

We believe your business is no one else's. Your privacy is important to you…and to us. So we'll protect the information you share with us. To protect your privacy, Trainerly follows different principles in accordance with world-wide practices for customer privacy and data protection.

WHAT INFORMATION WE MAY COLLECT

User-Provided Information: You may provide to Trainerly what is generally called “personally identifiable” information (such as your name, email address, postal mailing address, home/mobile telephone number, or demographic information) when using the Trainerly Service, such as when you register for the site, create User Submissions, and schedule Training Sessions.

“Cookies” Information: When you use the Trainerly Service, we may send one or more cookies – small text files containing a string of alphanumeric characters – to your computer. Trainerly may use both session cookies and persistent cookies. A session cookie disappears after you close your browser. A persistent cookie remains after you close your browser and may be used by your browser on subsequent visits to the Trainerly Service. Persistent cookies can be removed. Please review your web browser “Help” file to learn the proper way to modify your cookie settings. Please note that if you delete, or choose not to accept, cookies from the Trainerly Service, you may not be able to utilize the features of the Trainerly Service to their fullest potential.

“Automatically Collected” Information: When you use the Trainerly Service or open one of our HTML emails, we may automatically record certain information from your web browser by using different types of technology, including “clear gifs” or “web beacons.” This “automatically collected” information may include Internet Protocol address (“IP Address”) or other device address or ID, web browser and/or device type, the web pages or sites that you visit just before or just after the Trainerly Service, the pages you view on the Trainerly Service, and the dates and times that you visit the Trainerly Service.

Information from Other Sources: We may also obtain information, including personally identifiable information, from third parties and sources other than the Trainerly Service, such as advertisers, or other users who import your email address from their address book. We may also, at your direction, receive information from third party service that provide a mechanism to expose information you have provided to such third party through the use of an application program interface (API), such as Facebook Connect. HOW WE MAY USE COLLECTED INFORMATION

Trainerly uses the information you provide or that we collect to operate, maintain, enhance, and provide all of the features and services found on the Trainerly Service. We will use your email address to contact you for administrative purposes, such as confirming Training Sessions, for customer service purposes, to address intellectual property infringement, rights of privacy, or defamation issues, or regarding User Submissions that you have posted to the Trainerly Service.

Trainerly uses all of the information that you provide or that we collect to understand and analyze the usage trends and preferences of our users, to improve the way the Trainerly Service works and looks, and to create new features and functionality.

Trainerly may use “automatically collected” information and “cookies” information to: (a) personalize our services, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the Trainerly Service; (b) provide customized third party advertisements, content, and information; (c) monitor and analyze the effectiveness of Trainerly Service and third party marketing activities; (d) monitor aggregate site usage metrics such as total number of visitors and pages viewed; and (e) track your entries, submissions, and status in any promotions or other activities.

Trainerly may use your email address or other personally identifiable information to send you i) messages about the Trainerly Service, such as when you receive a friend request or a recommendation, ii) promotional messages related to the Trainerly Service and the activities of third parties we work with, and iii) messages on behalf of other users who think you may be interested in the Trainerly Service. You will have the ability to opt-out of receiving any such communications, either through links provided in the messages, or by updating your account preferences through the Trainerly Service.

Trainerly may use certain information provided during the Health Professional registration process, such as your name and your certifications, qualification, and other credentials, to perform a background check to verify the accuracy of the information you have provided.

HOW WE MAY DISCLOSE COLLECTED INFORMATION

Your privacy is very important to us, and we are not in the business of selling your information. We do, however, disclose your personally identifiable information in a variety of circumstances.

The Trainerly Service enables users to communicate in a variety of ways. Any personally identifiable information that you voluntarily choose to include in a publicly accessible area on the Trainerly Service, such as a public profile page or in a review or other User Submission, will be available to other users who access that content. This also applies to information you choose to make available through Trainerly features that connect to third party services, such as Twitter and Facebook. Trainerly may also syndicate content exposed in public areas of the site to third party services. Once you make your personally identifiable information available any of these ways, it may be collected and used by the recipients without restriction.

Trainerly may disclose information that you voluntarily choose to include upon registration or profile creation, such as your fitness assessment or fitness goals, with a Health Professional when you schedule a Training Session. If you choose not to share you fitness assessment or fitness goals with your Health Professional, you must opt-out of sharing this information either at the time of registration or by using the privacy settings on your profile page.

Trainerly discloses automatically collected and other aggregate non-personally-identifiable information with interested third parties to assist such parties in understanding the usage, viewing, and demographic patterns for certain programs, content, services, advertisements, promotions, and/or functionality on the Trainerly Service.

Trainerly works with third party service providers to provide website hosting and maintenance as well as other services for us. To the extent it is necessary for these service providers to complete their contractual obligations to Trainerly, these third parties may have access to or process your personally identifiable information. Generally, these disclosures are made under terms comparable to this policy, and the recipients are limited to using the information the purpose for which it was provided.

Trainerly may also disclose your information if required to do so by law or in the good-faith belief that such action is necessary to comply with state and federal laws (such as U.S. Copyright law), in response to a court order, judicial or other government subpoena or warrant, or to otherwise cooperate with law enforcement activity.

Trainerly also reserves the right to disclose your information that we believe, in good faith, is appropriate or necessary to take precautions against liability; to protect Trainerly and others from fraudulent, abusive, or unlawful uses or activity; to investigate and defend ourselves against any third party claims or allegations; to assist government enforcement agencies; to protect the security or integrity of the Trainerly Service; or to protect the rights, property, or personal safety of Trainerly, our users, or others.

Trainerly may disclose certain information provided during the Health Professional registration process, such as your name, and your certifications, qualification, and other credentials, to third parties to conduct a background check to verify the accuracy of the information you have provided.

CONSENT

If you choose not to register or provide personal information, you can still use most of Trainerly.com. But you will not be able to access areas that require registration.

If you decide to register, you will be able to select the kinds of information you want to receive from us by subscribing to various services, like our electronic newsletters. If you do not want us to communicate with you about other offers regarding Trainerly services by e-mail, postal mail, or telephone, you may select the option stating that you do not wish to receive marketing messages from Trainerly.

SECURITY

Trainerly has taken strong measures to protect the security of your personal information and to ensure that your choices for its intended use are honored. We take strong precautions to protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

We guarantee your e-commerce transactions to be 100% safe and secure. When you place orders or access your personal account information, you're utilizing a secure server software SSL, which encrypts your personal information before it's sent over the Internet. SSL is one of the safest encryption technologies available.

In addition, your transactions are guaranteed under the Fair Credit Billing Act. This Act states that your bank cannot hold you liable for more than $50.00 in fraudulent credit card charges. If your bank does hold you liable for $50.00 or less, we'll cover your liability provided the unauthorized, fraudulent use of your credit card resulted through no fault of your own and from purchases made from us over our secure server. In the event of unauthorized use of your credit card, you must notify your credit card provider in accordance with its reporting rules and procedures.

Trainerly strictly protects the security of your personal information and honors your choices for its intended use. We carefully protect your data from loss, misuse, unauthorized access or disclosure, alteration, or destruction.

Your personal information is never shared outside the company without your permission, except under conditions explained above. Inside the company, data is stored in password-controlled servers with limited access. Your information may be stored and processed in United States or any other country where Trainerly, its subsidiaries, affiliates or agents are located.

You also have a significant role in protecting your information. No one can see or edit your personal information without knowing your user name and password, so do not share these with others.

NOTICE TO PARENTS

Protecting the privacy of young children is especially important. For that reason, Trainerly does not knowingly collect or maintain personally identifiable information from persons under 13 years-of-age, and no part of the Trainerly Service is directed to persons under 13. If you are under 13 years of age, then please do not use or access THE TRAINERLY SERVICE at any time or in any manner. If Trainerly learns that personally identifiable information of persons less than 13-years-of-age has been collected on the Trainerly Service without verifiable parental consent, then Trainerly will take the appropriate steps to delete this information. If you are a parent or guardian and discover that your child under the age of 13 has obtained an account on the Trainerly Service, then you may alert Trainerly at GetFit [at] Trainer.ly and request that Trainerly delete that child's personally identifiable information from its systems.

CUSTOMER PROFILES

As mentioned above, every registered customer has a unique personal profile. Each profile is assigned a login ID, which helps us ensure that only you can access your profile.

When you register, we create your profile, assign a login ID, then send this personal identification number back to your hard drive in the form of a cookie, which is a very small bit of code. This code is uniquely yours. It is your passport to seamless travel across Trainerly.com, allowing you to use our services without having to fill out registration forms with information you've already provided. Even if you switch computers, you won't have to re-register – just use your Login ID and password to identify yourself.

INTERNATIONAL VISITORS

This Site is hosted in the United States. If you are an international visitor, you should note that by providing your personally identifiable information, you are: (i) permitting the transfer of your personally identifiable information to the United States which may not have the same data protection laws as the country in which you reside; and (ii) permitting the use of your personally identifiable information in accordance with this Privacy Policy. In the Event of Merger or Sale:

In the event that all or a portion of Trainerly or its assets are acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information that we have collected from users in connection with such merger, acquisition, sale, or other change of control.

CHANGES AND UPDATES

Please revisit this page periodically to stay aware of any changes to this Privacy Policy, which may be revised periodically at Trainerly's sole discretion, as provided in Section 4 of the Trainerly Terms of Service. If we modify the Privacy Policy, we will make it available through the Trainerly Service, and indicate the date of the latest revision. In the event that the modifications materially alter your rights or obligations hereunder we will make reasonable efforts to notify you of the change. For example, we may send a message to your email address, if we have one on file, or generate a pop-up or similar notification when you access the Trainerly Service for the first time after such material changes are made. Our amended Privacy Policy will automatically take effect 30 days after it is made available through the Trainerly Service, except that (i) we generally only use your personally identifiable information in the manner described in the Privacy Policy in effect when we received that information and (ii) if you do not agree with any changes to the Privacy Policy, you may terminate your account ceasing use of the Trainerly Service. Your continued use of the Trainerly Service after revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Privacy Policy.
